Specific service terms, deliverables, and pricing are detailed in individual service agreements executed between GrowthWave Digital and the client.

3. Eligibility

You must be at least 18 years of age and have the legal authority to enter into a binding agreement to use our services. By using our website, you represent and warrant that you meet these requirements.

4. User Accounts

Certain features of our platform, including the partner portal and admin dashboard, require account creation. You are responsible for maintaining the confidentiality of your account credentials and for all activities that occur under your account. You agree to notify us immediately of any unauthorized use.

5. Payment Terms

Payment terms are governed by the specific service agreement between you and GrowthWave Digital. Our performance-based services (SBO, Pay-Per-Result SEO) are billed based on verified results as outlined in your service agreement. Other services may be billed on a per-lead, per-project, or monthly basis. All fees are non-refundable unless otherwise specified in your individual service agreement.

6. Intellectual Property

All content on this website — including text, graphics, logos, icons, images, software, and design elements — is the property of GrowthWave Digital or its content suppliers and is protected by intellectual property laws. You may not reproduce, distribute, modify, create derivative works of, publicly display, or otherwise exploit any content without our prior written consent.

7. Client Responsibilities

When engaging our services, you agree to provide accurate and complete information about your business; grant necessary access to accounts, platforms, and assets required to deliver services; respond to requests for approvals and feedback in a timely manner; and comply with all applicable laws regarding your business and marketing activities.

8. SMS / Text Messaging Program

Program & Use Cases

GrowthWave Digital (a brand operated by Vanlex Commerce LLC) operates an SMS program for prospects and clients who book a discovery call. Messages are transactional and conversational in nature and include: appointment confirmations, appointment reminders, rescheduling notifications, follow-up communication from your account representative, and service-related updates relevant to your engagement with our team.

Opt-In

You opt in to the SMS program by submitting your phone number through our booking form located at growthwave.digital/book. You must be at least 18 years of age to opt in. By opting in, you expressly consent to receive recurring text messages from GrowthWave Digital at the mobile number you provide.

Message Frequency

Message frequency is recurring and varies based on your booking activity and ongoing conversation with our team — typically 2 to 6 messages per month.

Message & Data Rates

Message and data rates may apply, charged by your mobile carrier. GrowthWave Digital does not charge you for the messages themselves.

Opt-Out

You may cancel the SMS service at any time by replying STOP to any message you receive from us. After you send STOP, we will send you a confirmation message and you will not receive further SMS messages from us. To resubscribe, sign up again through the booking form or reply START. Opting out of SMS will not affect appointments you have already scheduled.

Carrier Disclaimer

Mobile carriers are not liable for delayed or undelivered messages. Message delivery is subject to the effective transmission of your mobile carrier and is not guaranteed.

9. Disclaimers

Our services are provided on an "as-is" and "as-available" basis. While we strive for measurable results, digital marketing outcomes depend on numerous factors including market conditions, competition, and platform algorithm changes. We do not guarantee specific rankings, traffic volumes, or revenue outcomes except where explicitly stated in a performance-based service agreement with defined success criteria.

10. Limitation of Liability

To the maximum extent permitted by law, GrowthWave Digital shall not be liable for any indirect, incidental, special, consequential, or punitive damages, including loss of profits, data, or business opportunities, arising out of or in connection with your use of our website or services — regardless of the theory of liability. Our total liability for any claim shall not exceed the amount you paid to us in the twelve months preceding the claim.

11. Indemnification

You agree to indemnify and hold harmless GrowthWave Digital, its officers, directors, employees, and agents from any claims, liabilities, damages, losses, and expenses (including reasonable attorney's fees) arising out of your use of our services, your violation of these terms, or your violation of any rights of a third party.
